Smith and Associates, LLP appeals the trial courts take-nothing judgment granted in favor of Advanced Placement Team, Inc. and Renee Yousey (collectively APT). In four issues, Smith argues the trial court erred in (1) construing the statutory definition of advertisement and finding APTs transmissions were not advertisements; (2) finding that Smith invited the transmissions; (3) failing to find that APT had not responded within 24 hours of Smiths request to remove his telephone number; and (4) failing to find Advanced Placement Team and Yousey jointly and severally liable for the alleged TCPA violations. We affirm the trial courts judgment in part and reverse and remand in part.
